SHIPPING & DELIVERY POLICY

BritTrack Logistics Ltd (“the Company”) provides:

  • UK domestic transport

  • EU cross-border transport

  • International freight forwarding

  • Air, sea, and road freight

  • Customs clearance

  • Warehousing & distribution

  • Last-mile delivery (where contracted)

All services are subject to our Terms & Conditions.

1. Important Legal Framework

BritTrack operates under applicable transport conventions and regulations, including where relevant:

  • UK Carriage of Goods by Road Act 1965 (CMR Convention)

  • EU CMR Convention

  • Hague-Visby Rules (Sea Freight)

  • Montreal Convention (Air Freight)

  • UK Consumer Rights Act 2015 (where applicable)

  • EU Consumer Rights Directive 2011/83/EU (where applicable)

Freight and logistics services are governed primarily by transport law, not standard retail refund law.

2. Delivery Timeframes

2.1 Estimated Delivery Times

All delivery times are estimates only and are not guaranteed unless expressly confirmed in writing.

Estimated timelines vary depending on:

  • Service level (Standard / Express / Priority)

  • Customs clearance

  • Regulatory inspections

  • Port congestion

  • Weather conditions

  • Carrier schedules

The Company shall not be liable for delays outside its direct control.

3. UK Domestic Deliveries

  • Standard: 1–3 business days

  • Express: Next working day (where available)

  • Remote Areas: Additional 1–2 days may apply

Deliveries to Northern Ireland may be subject to customs formalities under UK–EU arrangements.

4. EU & International Deliveries

International transit times depend on:

  • Destination country

  • Customs processing

  • Regulatory compliance

  • Trade restrictions

Transit times are indicative only.

The Company is not liable for customs-related delays.

5. Customs Clearance

The Customer is responsible for:

  • Accurate customs documentation

  • Correct commodity classification

  • Duties and VAT

  • Import licences

Failure to provide accurate documentation may result in:

  • Delays

  • Seizure

  • Fines

  • Storage charges

The Company acts as agent unless otherwise contracted.

6. Delivery Attempts

6.1 Deliveries require signature unless otherwise agreed.

6.2 If delivery cannot be completed:

  • A reattempt may be made

  • Storage charges may apply

  • Goods may be returned to depot

6.3 After 14 days of non-collection, goods may be disposed of in accordance with lien rights.

7. Risk & Transfer of Responsibility

Risk transfers:

  • Upon delivery signature; or

  • Upon placement at delivery location if authorised

If goods are left without signature at Customer request, liability ends at time of delivery.

8. Liability for Loss or Damage

Liability is limited to applicable international conventions:

Road (CMR)

8.33 SDR per kg

Air (Montreal Convention)

22 SDR per kg

Sea (Hague-Visby Rules)

666.67 SDR per package or 2 SDR per kg

The Company shall not be liable for:

  • Consequential losses

  • Loss of profit

  • Market loss

  • Regulatory penalties

  • Indirect damages

  • Seizure by authorities

Maximum liability shall not exceed the amount paid for the service unless additional insurance was purchased.

9. Insurance

Standard transport liability is limited.

Customers must request additional cargo insurance prior to dispatch.

Failure to declare value limits compensation to statutory minimums.

10. Undeliverable Shipments

Shipments may be considered undeliverable if:

  • Incorrect address provided

  • Refusal by recipient

  • Unpaid duties

  • Regulatory restrictions

Return shipping and storage fees apply.

11. Force Majeure

The Company shall not be liable for delay or failure caused by:

  • Natural disasters

  • Strikes

  • Border closures

  • War

  • Government restrictions

  • Carrier network disruptions

  • Customs holds

12. Hazardous & Restricted Goods

The Company may refuse:

  • Dangerous goods not declared

  • Restricted exports

  • Counterfeit goods

  • Perishable goods (unless agreed)

Undeclared dangerous goods may result in termination without refund.

13. Claims Process

13.1 Visible damage must be reported within 24 hours.

13.2 Concealed damage must be reported within 7 days.

13.3 Delay claims must be made within 21 days.

Failure to comply voids claim rights.

14. Storage & Demurrage

If shipments are delayed due to:

  • Customs issues

  • Incomplete documentation

  • Payment delays

Storage and demurrage charges may apply.

15. Governing Law

UK shipments governed by laws of England & Wales.

EU shipments governed by applicable EU transport conventions and local jurisdiction regulations.
