1. Definitions
In these Terms:
“Company” means BritTrack Logistics Ltd.
“Customer” means the shipper, sender, consignee, or contracting party.
“Goods” means cargo, freight, packages, containers, or items handled.
“Services” means transport, warehousing, customs clearance, distribution, and related logistics services.
“Convention” refers to applicable transport conventions (CMR, Montreal, Hague-Visby, etc.).
2. Scope of Application
2.1 These Terms govern all services provided by the Company within the United Kingdom, European Union, and internationally.
2.2 These Terms override any conflicting terms proposed by the Customer unless expressly agreed in writing by a Director of the Company.
2.3 By booking services, the Customer confirms acceptance of these Terms.
3. Regulatory Framework
Services may be governed by:
UK Carriage of Goods by Road Act 1965 (CMR Convention)
EU CMR Convention
Montreal Convention (Air)
Hague-Visby Rules (Sea)
UK Consumer Rights Act 2015 (where applicable)
EU Commercial & Transport Directives
Where international conventions apply, liability shall be determined strictly in accordance with those conventions.
4. Customer Obligations
The Customer warrants that:
4.1 All information provided is accurate and complete.
4.2 Goods are properly packaged, labelled, and compliant with applicable regulations.
4.3 All customs documentation is accurate and lawful.
4.4 The Goods are not prohibited, restricted, hazardous, illegal, or counterfeit unless expressly declared and accepted.
The Company shall not be liable for delays, losses, fines, or seizures caused by inaccurate documentation.
5. Prohibited & Restricted Goods
The Company reserves the right to refuse carriage of:
Illegal goods
Dangerous goods not properly declared
Counterfeit or restricted items
Perishable goods without written acceptance
Cash, precious metals, or high-value items unless insured
Undeclared dangerous goods may result in immediate termination of service without refund.
6. Charges & Payment
6.1 All charges are payable as invoiced.
6.2 The Company may require advance payment.
6.3 Late payments may incur interest at 8% above the Bank of England base rate.
6.4 The Company retains a general lien over Goods for unpaid sums.
7. Liability Limitations (Very Strong Protection Section)
7.1 The Company’s liability is strictly limited to statutory transport convention limits unless additional insurance is purchased.
Road (CMR)
8.33 SDR per kilogram of gross weight lost or damaged.
Air (Montreal)
22 SDR per kilogram.
Sea (Hague-Visby)
666.67 SDR per package or 2 SDR per kilogram (whichever higher).
7.2 The Company shall not be liable for:
Loss of profits
Business interruption
Consequential losses
Regulatory penalties
Indirect damages
Loss arising from customs seizure
Loss caused by force majeure
7.3 Liability shall never exceed the amount paid for the service.
7.4 No employee or agent has authority to increase liability unless confirmed in writing by a Director.
8. Insurance
8.1 Standard liability is limited under conventions.
8.2 Additional cargo insurance must be declared and paid for before dispatch.
8.3 Failure to declare value limits compensation.
9. Delivery & Delay
9.1 Delivery dates are estimates only.
9.2 The Company shall not be liable for delays caused by:
Customs
Port congestion
Government inspections
Weather conditions
Carrier disruptions
Regulatory intervention
10. Customs Clearance
10.1 The Customer acts as importer/exporter of record unless otherwise agreed.
10.2 The Customer is responsible for:
Duties
Taxes
Regulatory compliance
Fines arising from documentation errors
10.3 The Company acts solely as agent for customs processing unless explicitly contracted otherwise.
11. Claims Procedure
11.1 Claims must be submitted:
Within 24 hours for visible damage
Within 7 days for concealed damage
Within 21 days for delay
11.2 Failure to comply invalidates claim rights.
12. Force Majeure
The Company shall not be liable for events beyond reasonable control, including:
War
Strikes
Natural disasters
Government actions
Border closures
Pandemics
13. Suspension & Termination
The Company may suspend or terminate services if:
Payment is overdue
Goods are unsafe
Documentation is false
Legal compliance risks arise
No refunds shall be payable for termination due to Customer breach.
14. Data Protection
Personal data is processed in accordance with UK GDPR and EU GDPR regulations.

15. Jurisdiction & Governing Law
UK Customers
Governed by the laws of England & Wales.
EU Customers
Where applicable, disputes may be governed by EU jurisdiction regulations.
Courts of England & Wales shall have exclusive jurisdiction unless Convention law requires otherwise.
16. Severability
If any clause is deemed invalid, the remainder shall remain enforceable.
17. Amendments
The Company may update these Terms at any time.
